Who owns the copyright in your CD cover?

The fact that the CD cover of a young artist may feature, for example, a photograph of him strumming away at his beloved guitar, gazing into the distance, does not necessarily mean that that the bright eyed artist owns the copyright in the CD cover.
If the bright-eyed artist was responsible for the composition of the photograph, he may own the copyright in the photographic work. If the artist’s manager, however, delivered some input on the positioning of the artist with his guitar, the manager may own the copyright in the photograph. That being said, the issue of ownership of copyright in the CD cover, does not end here.
It is unlikely that a CD cover will consist solely of a photograph of the bright eyed artist. Some fanciful writing, the artist’s and album name would probably feature on the cover. And so, other aspects of the CD cover would also be protected by copyright and different rules of ownership would apply to each aspect.
Furthermore, there are certain exceptions to ownership. If the bright eyed artist commissioned and paid the photographer to take his photograph, he would own the copyright in the photograph. However, in most instances, the artist’s record label would have commissioned the taking of the photograph and would, as a result, own the copyright vesting in the photograph.
It is clear from the above that, in respect of a CD cover, more than one aspect may be protected by copyright and is possible that different people will own the copyright.
It is advisable that one person or entity (like a record label) owns all the relevant copyright in respect of a CD cover, to avoid any uncertainty. In this regard, the copyright in the relevant works should be assigned, in writing, to one person or entity. An entertainment lawyer should be consulted to ensure that all the possible works are identified and correctly assigned to the relevant person.

Producer/engineer Andy Johns comes from a family of sound engineers. His older brother is Glyn Johns (The Who, Eagles, Rolling Stones, Led Zeppelin) and his nephew is Ethan Johns (Ryan Adams, Kings of Leon, Kaiser Chiefs, Rufus Wainwright). For a year Ann co-anchors the floundering morning TV show beside Matt Lauer, until her ouster on June 28, 2012. JRRR uncovers a rash of behind the scenes harsh behavior. A staff member confesses: In the past, [former ‘Today’ host Katie] Couric would sometimes tease her about her clothes. One staff member recalls that a lot of time in the control room was spent making fun of Ann’s outfit choices or just generally messing with her. Perhaps, being pushed out of Today’s lion’s den is probably the best thing that can happen to Curry. The New York Times publishes a piece by Matt Lauer’s arch nemesis, Brian Stelter, titled Top of the Morning: Inside the Cutthroat World of Morning TV.
ROCK GROUP BADFINGER’S LATE FOUNDER RECEIVES AWARD Wales Rock quartet Badfinger begins as The Iveys with Pete Ham (guitar), Tom Evans (bass), Joey Molland (guitar) and Mike Gibbins (drums). All members of Badfinger share vocal duties except Gibbins. The group’s first hit is Come and Get It in February 1970 that reaches #7. In 1971/72 Day After Day is their biggest hit at #4 with a half million in sales. The group combats two tremendous tragedies first when Pete Ham commits suicide at 27 on April 23, 1975. After Ham dies, Badfinger disbands. In 1979, Molland and Evans reunite. On November 23, 1983 Evans takes his life at 36. The English Heritage honors the late Pete Ham who founds Wales Rock quartet Badfinger with one of Britain’s Blue Plaques.

Watch what you say: With today’s media coverage, social networking, and cell phones, it is more important than ever to watch what you say. Every major network has apologized over and over again recently for broadcasting inaccurate information concerning the recent Boston Marathon bombing.
It is almost as if the channel that can sensationalize the event the most is the one that gets the most views and thus lays the problem. If you are watching a network with coverage that is boring you instantly switch over to a different channel where there is some action. News reporters that announce an update and have to constantly reiterate that the update is unconfirmed would be far better off not saying it at all is my opinion.
To over simplify the circumstance it is like giving candy to a baby and then taking it away. In the defense of all the networks I must say however that their untiring efforts should be commended. I know of one announcer that stayed up for 72 hours unselfishly to bring us the latest news.

Since WHISNews21 published the article on Irene the Champion Runner from a White Squatter Camp in South Africa, we have had an amazing response from people worldwide who want to help this young girl. We have finally contacted the person who initially posted Irene story on his Blog late last year and he has at our request send us a report on his involvement with Irene. Much to our surprise he has a Ph.D. from Oxford University, England and now lives in the United States of America and is himself an outstanding and caring person. I have added his article below for all the concerned visitors to WHISNews21 who want to know more about Irene.
Follow up on Irene – the runner in the squatter camp.
I was amazed at the recent response from South Africans about the plight of Irene, the 15-year-old girl who is a champion runner but lives in a White squatter camp near Pretoria. Let me tell you how all of this began.
My name is Skip Moen. I am the founder of At God’s Table, a non-profit biblical education charity. I have a Ph.D. from Oxford University in England. I spent 25 years in business before I started writing and teaching. I teach all over the world. I have authored several books and dozens of articles. I am currently the Academic Dean of Master’s International Divinity School in Evansville, Indiana in the USA.
A few years ago I started coming to South Africa to teach. In the process, I met people who had dedicated their lives to helping those in real need, especially the ones who no one knows about. That’s how I ended up touring the camp where Irene lives. I met Irene and her family and heard her story and I knew immediately that I had to do something to help her. So I went home to Orlando and told her story to the hundreds of people who follow my work on my web site. People from all over the world responded and we raised money to assist Irene with racing needs, expenses, food and medical bills. I never thought that WHISNews21 would publish this story and make this public. I posted an interview with Irene that I filmed the next time I was in South Africa. It is now on You Tube. Last time I was in South Africa I went to one of Irene’s races. She won both the 800 and the 1500 meter races. A happy girl, for sure. Irene’s father is perhaps her greatest admirer and advocate. He helps manage the camp where the family lives.
In case you think that my efforts are only aimed at Whites, you need to know that I have drilled wells in Haiti, built houses for the poor in Honduras, offered assistance in Indonesia and recently taught a class in a public school in South Africa.
I really go where God leads me and do what He asks me to do for those I meet who are in need. That’s what compassion means.

I include this article from Business Warriors in this PetesWeekly because I have had a very challenging commuting week. My suitcase decided to play hooky in Frankfurt while I arrived in Johannesburg.
By this morning I had acquired a gentle Gorgonzola-like glow. The suitcase arrived just in time to accompany me into some troubled weather in Cape Town, where I will be setting up office. My hosts insist that a bath is more important than some petty commercial scrivening, and frankly, I am all for it.
This article lists those things that Business Warriors think are worth doing periodically, even if they are cumbersome. This is because they show us the hidden health of our business before it becomes a crisis.
For instance, applying for a Tax Clearance Certificate each year is a pain, especially if you do not need it right now. But, it is the easiest way to confirm SARS regards you as up to date. (Sure you can ask them if you are, as many have done, but you cannot trust their answer, as many have found out when they desperately needed the certificate.) It can takes weeks/months to resolve the documents that SARS may have lost, or your payments that may have fallen into the wrong allocation, and when you urgently need the certificate to complete a tender that time is not available.
Next, try applying for some credit each year, like a credit card, even if you don’t need one. This instantly highlights whether somebody has snuck a judgment against you into the system. (Yes, they are supposed to warn you, but that warning seems to astray enough times for the rest of us to think it might be a conspiracy.)
Next, try checking your current business registration status each year at CIPC. (The Companies and Intellectual Property Commission. This used to be CIPRO, which still exists in hiding.) You search for your firm name in the lowest search block in the left hand menu.
Recovering from de-registration is a little like trying to claim for a car accident that happens the day after your bank bounces your short-term premium. (I tried it, and it was a catastrophe.)
Next, review your BBBEE status each year. The law changes often enough to make this worthwhile. And your business keeps changing as well. Just being aware of your BBBEE rating means that you will see ways to improve it. This is like standing on a scale each morning. Just knowing what your weight is prompts you to eat a little more carefully.

Gun laws are so strict in South Africa that most South Africans are just handing in their guns at the police stations. If they were not able to obtain a licence and they were caught with the guns they would be committing a criminal offence which would most certainly include a jail sentence. Now most law-abiding South African are unarmed while almost all criminals are armed and dangerous. Now it’s like Deer hunting in South Africa “Open Season” only the season is all year-long.
It seems that this could happen where you live too, if Gun Control is passed.
